This Privacy Policy (Policy) describes how PERI Formwork Systems, Inc. (collectively referred to as we or our or us in the Policy) collects, stores, shares, and uses information, and your choices about privacy, when you use our websites, mobile applications, and other mechanisms in the United States through which you can access the Services and Content or otherwise communicate with us (collectively, the Sites).

Introduction

This Policy applies to your use of the Sites and any services accessible through the Site (Services) or Content accessible through the Sites, except to the extent access to the same is through link to third-party sites, in which case the privacy policies of those third-party sites govern:

This Policy sets out the basis on which any personal information we collect from you, or that you provide to us, will be processed by us. This Policy does not apply to job applicants, current or former employees, or their families to the extent a separate policy addressing privacy has been provided, in which case that separate policy shall govern.  Please contact us about obtaining information regarding the same.

Please note that if United States federal law or the law of your state provides for privacy protections that conflict with the provisions of this Policy, the law of the United States or your state’s laws shall apply as required or mandated and applicable.

Changes to the Policy and Consent

This Policy will be reviewed and updated from time to time.  We reserve the right to change this Policy at our discretion at any time.  Material changes will be posted on the Sites and reflect an updated effective date.  Your continued use of the Sites constitutes your acceptance of the Policy and any changes made thereto.     

Minors

The Sites are not intended for children under the age of 16.  We do not knowingly collect information relating to children under the age of 16, and if we determine that we have received personal information from a person under the age of 16, we will delete it.  We are in compliance with the Children’s Online Privacy Protection Act. 

Third-Party and Social Media Links

The Sites may contain links to and from the websites or applications of third parties, including the websites of related entities, suppliers, contractors, and/or other service providers.  This Policy does apply to any such access to third-party websites or applications that may be linked to or from the Sites.  We disclaim any responsibility for the privacy and other practices of these third parties.  Please consult the privacy policies and practices of those third parties as appropriate.  

The Sites also link, integrate, or have “plug-ins” with social media websites or applications, including, but not limited to, LinkedIn, Facebook, Instagram, Twitter, and YouTube.  If you interact with these features, please carefully consult the terms and use, privacy policies, and your account settings with these third-party social media entities.  These entities may collect, share, and sell your personal information.    

Additionally, the Sites may include links to and from our parent company and its subsidiaries located outside of the United States.  Please consult the separate privacy policies appliable to those affiliated entities.  

Cookie Policy

Cookies are small text files placed on your computer by websites you visit for various purposes.  We utilize cookies that are technically necessary and that increase the functionality of using the Sites.  You may limit or disable the use of cookies through most web browsers, but this may affect the functionality of, or access to, the Sites.  We may also utilize cookies, web beacons, and/or website tracking technologies, including but not limited to Google Analytics, for our business or analytical purposes, such as assessing website traffic and understanding how customers utilize the Sites.  However, as explained elsewhere in this Policy, we do not sell your personal information to third parties; however, your information may be accessible by PERI’s related entities and affiliates.  You may be required to accept or “opt in” to the use of certain categories of cookies to access portions of the Sites, including the use of myPERI.

Data Retention

Our services employ technologies that may use persistent or session-based storage, depending on the technology type and nature of the service the technology is enabling.

Persistent storage: Persistent data remains on a user’s device or in a browser’s cache for the period of time specified by the technology and is automatically deleted afterwards.   Oftentimes, the storage duration is reset each time that the user accesses the Service capturing the persistent stored data.

Session based: Session data is only stored temporarily (i.e., for that session) and expires once you close your browser (or once your session ends).  For example, a browser session starts when a user opens the browser window and finishes when the user closes the browser window.  In that example, once the browser is closed, all session data is deleted.

General Cookie Information

“Strictly Necessary Cookies” are always active and are necessary for a website to function and cannot be switched off in our systems. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences, logging in or filling in forms.    You can set your browser to block or alert you about these cookies, but some parts of the site will not then work. These cookies do not store any personally identifiable information

“Social Media Cookies” are set by a range of social media services that we have added to the site to enable you to share our content with your friends and networks. They are capable of tracking your browser across other sites and building up a profile of your interests. This may impact the content and messages you see on other websites you visit.    If you do not allow these cookies, you may not be able to use or see these sharing tools.

“Functional Cookies” enable a website to provide enhanced functionality and personalization. They may be set by a website or by third party providers that provide services for a website.    If you do not allow these cookies, then some or all of these services may not function properly.

“Performance Cookies” allow websites to count visits and traffic sources so they can measure and improve the performance of the sites. They provide information on what pages are the most and least popular and see how visitors move around the site.    All information these cookies collect is aggregated and therefore anonymous. If you do not allow these cookies, a website will not know when you have visited the site, and will not be able to monitor its performance.

“Targeting Cookies may be set through a website or by advertisers on a website. They may be used by those companies to build a profile of your interests and show you relevant adverts on other sites.    They do not store directly personal information, but are based on uniquely identifying your browser and internet device. If you do not allow these cookies, you will experience less targeted advertising.  PERI does not utilize targeting cookies.

What Categories of Personal Information Do We Collect?

We collect information you voluntarily provide to us through the Sites.  We also collect technical information through cookies and similar technologies.  Please see our Cookie Policy contained herein for more information.    

We have collected (directly or through third-party applications) the following categories of personal information in the last twelve months:

  • Providing our newsletter if you elect to subscribe to it;
  • Participation in customer surveys or contests; and
  • Facilitation in the delivery of our Services and to respond to your inquiries

We also collect, use and share “Aggregated Data”, meaning data such as statistical or demographic data, for any purpose. Aggregated Data could be derived from your personal information but is not considered personal information in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific Site feature. However, if we combine or connect Aggregated Data with your personal information so that it can directly or indirectly identify you, we treat the combined data as personal information which will be used in accordance with this Policy.

We do not currently collect any Sensitive Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data), nor do we collect any information about criminal convictions and offenses, unless voluntarily reported by you.

We currently do not collect any financial data in connection with your use of the Sites. Any purchases that you make in connection with our products or Services are processed through a third-party payment processor.

How Do We Use and Share Your Personal Information?

We use your personal information for our business purposes.  We do not sell your personal information to third parties.  However, we may use or share your personal information as described in this Policy, including, but not limited to, as follows:    

We may disclose your personal information with our parent company and any subsidiaries or affiliates of our parent company.

We may disclose your personal information with our contractors and service providers, pursuant to a written contract between us and each contractor or service provider.

We may disclose your personal information as part of a sale, merger or acquisition, or other transfer of all or part of our assets, including as part of a bankruptcy proceeding.

We may disclose your personal information pursuant to a subpoena, court order, or other legal proceeding, or as otherwise required by law, regulation, or to protect our rights or the safety of third parties. 

We may share information that has been de-identified or aggregated without restriction. 

Privacy Rights

You may exercise all privacy rights afforded to you by applicable federal and state law in the United States.  Residents of California should review the separate section of this policy entitled Information Specific to California Residents.  

To exercise these rights, including any requests to access, correct, or restrict the processing of your personal data, you can contact us by following the Contact Information section of this Policy. If you have a complaint about how we handle your data, we would like to hear from you.

Information Specific to California Residents

This section of the Policy applies to residents of California and compliance with state privacy laws, including the California Privacy Rights Act (CPRA) to the extent applicable. 

You may opt-out of the selling or sharing of your personal information for value (other than in connection with a transfer of your information pursuant to the immediately preceding paragraph), by going to our “Do not sell or share my Personal Information” page. You may limit our use of your sensitive information to the purposes for which it was collected by going to our “Do not expand our use of my Sensitive Information” page.

Right to be informed

Depending on the circumstances, you have a right to know:

  • whether we collect and use your personal information;
  • the categories of personal information that we collect;
  • the purposes for which the collected personal information is used;
  • whether we sell your personal information to third parties;
  • the categories of personal information that we sold or disclosed for a business purpose;
  • the categories of third parties to whom the personal information was sold or disclosed for a business purpose; and
  • the business or commercial purpose for collecting or selling personal information.

In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.

Right to request deletion and/or correction of the data

You can ask for the deletion and/or correction of your personal information. If you ask us to delete or correct your personal information, we will honor the request, subject to certain exceptions provided by law.

You can exercise any of these rights at any time by referring to the contact details listed in the Contact Information section above.

Right to non-discrimination

We will not discriminate against you if you exercise your privacy rights under California law.

Verification process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with the information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

If you are using an authorized agent, to the extent allowed by law to act on behalf of a resident, to exercise your right to opt-out, we may deny a request if the authorized agent does not submit proof of valid authorization to act on your behalf.

International Data Transfers and Users

PERI Formwork Systems, Inc. operates in the United States. However, our related entities and affiliates, as well as our third-party vendors, are worldwide.  The processing of your personal information may involve a transfer of data to countries outside of the United States.

Data privacy laws and rights vary from one country to another.  Our affiliates that operate in the European Economic Area comply with the General Data Protection Regulation (GDPR).  While this Policy applies to United States based users of the Sites, and to PERI Formwork Systems, Inc.’s operation in the United States, we have adopted reasonable measures to comply with international privacy standards.   

Data Security

All information you provide to us is stored on our secure servers. Once we have received your information, we will use strict procedures and security features to try to prevent your personal information from being accidentally lost, used or accessed in an unauthorized way. Of course, no data transmissions or storage can be guaranteed as completely secured in all circumstances and we do not warrant against data breach.

We will collect and store personal information on your device using application data caches and browser web storage (including HTML5) and other technology.

Where we have given you (or where you have chosen) a password that enables you to access certain parts of the Sites Services, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Certain Services may include social networking, chat room or forum features. Ensure when using these features that you do not submit any personal information that you do not want to be seen, collected or used by other users.

We use a third-party payment processor to coordinate payment transactions and this information will be encrypted using Secured Sockets Layer technology.

We have put in place procedures to deal with any suspected personal information breach and will notify you and any applicable regulator of a personal information breach when we are legally required to do so.

Data Retention

Generally, PERI will retain your personal information only for as long as we require in order to maintain our business relationship.

By law, we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) after they cease being customers for tax and other legal purposes.

In some circumstances, we will anonymize your personal information (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.
